Once Gamba exits beta testing, this withdrawal limit will be lifted, and standard withdrawal policies will apply.
8.12.2 Avoidance Prohibition: The beta testing withdrawal limit, specifically the $50,000 profit cap, cannot be circumvented through the use of tipping, transferring funds between accounts, or the creation and use of multiple accounts (multi-accounting). Gamba strictly prohibits these practices as they can undermine the integrity of the testing environment and violate anti-money laundering policies. Attempts to bypass the profit withdrawal limit through such means will result in immediate account review, potential suspension, and corrective actions up to and including permanent closure of the involved accounts.

9. PROTECTION OF PLAYER FUNDS AND WAGERING TERMS

14. LIMITATIONS OF LIABILITY

14.1.1 Exclusion of Liability: Gamba will not be liable for any special, incidental, direct, indirect, or consequential damages resulting from the use or misuse of the Service. This encompasses, but is not limited to, loss of profits, business interruption, or loss of information, regardless of whether Gamba was advised of the possibility of such damages.

14.2 Exceptions to Limitations
14.2.1 Non-excludable Liabilities: Notwithstanding the above, nothing in this Agreement will limit or exclude Gamba's liability for death or personal injury caused by its negligence, or any other liability that cannot be excluded under applicable law.

15.1.1 Rights Ownership: Gamba and its licensors retain all rights, titles, and interests in and to the Service, including all related code, structure, organization, copyright, trade secrets, intellectual property, and other rights. You are prohibited from engaging in Unauthorized Use, which includes but is not limited to copying, distributing, publishing, reverse engineering, decompiling, disassembling, modifying, or translating the website or using the Service in any way that is prohibited by applicable laws.

16.1.2 Further Remedies: If the resolution provided does not meet your satisfaction, you are entitled to seek further legal remedies as governed by the jurisdiction outlined below.

17. GOVERNING LAW AND JURISDICTION

17.1 Applicable Law: All matters relating to the Service, including the Agreement itself, shall be governed and construed according to the laws of the jurisdiction in which Gamba is operated. By using the Service, you are agreeing to be bound by these laws.
17.2 Jurisdiction and Legal Proceedings: You irrevocably agree that the courts of the jurisdiction where Gamba operates will have exclusive jurisdiction over any disputes, claims, or controversies concerning the Agreement and any related matters. You waive any objections related to the proceedings being brought in these courts, including any claims of inconvenient forum or lack of jurisdiction. Gamba retains the right to initiate proceedings in any other jurisdiction where it sees fit.
17.3 Individual Proceedings: All legal claims or disputes arising under these Terms of Service must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You also agree to waive any right to a trial by jury where applicable.

18. SEVERABILITY OF TERMS

18.1 Maintaining Validity and Enforceability: Should any part of this Agreement be deemed illegal, invalid, or unenforceable in any jurisdiction, such determination shall not affect the remaining provisions of this Agreement. The legality, validity, and enforceability of the affected provision in any other jurisdiction, as well as the legality, validity, and enforceability of other provisions in the same jurisdiction, shall remain unaffected.

19. ASSIGNMENT OF AGREEMENT

19.1 Right to Assign: Gamba reserves the right to assign this Agreement, in whole or in part, at any time without prior notice. This means that Gamba may transfer its rights and obligations under this Agreement to another entity or party.

19.2 User Restrictions: As a user, you are not permitted to assign any of your rights or obligations under this Agreement. This ensures that the responsibilities and rights under this Agreement remain with the original contracting party unless explicitly changed or assigned by Gamba.

20. MISCELLANEOUS

20.1 Waiver: No failure or delay by Gamba in exercising any right, power, or privilege under this Agreement will operate as a waiver, nor will any single or partial exercise preclude any other or further exercise of any right, power, or privilege.

20.2 Third-Party Rights: This Agreement does not create any rights enforceable by any person not a party to it, except as specifically provided herein.

20.3 Relationship of Parties: Nothing in this Agreement is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, nor constitute any party the agent of another party, nor authorize any party to make or enter into any commitments for or on behalf of the other party.

20.4 Entire Agreement: This Agreement represents the entire understanding between the parties regarding the subject matter herein and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
